Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Smart Animal application, websites and related services (“Smart Animal” or the “Service”).
Smart Animal is operated by Smart Animal Technologies Ltd (“Smart Animal Technologies”, “we”, “us” or “our”), a company registered in England and Wales, company number 17299073, with registered office at Flat G4 Delta House, St. Andrews Street, Northampton, England, NN1 2HA.
Please read these Terms carefully before using Smart Animal.
By creating an account and confirming your acceptance (for example, by selecting “I agree”), you agree to these Terms. If you do not agree to them, you must not use Smart Animal.
Our Privacy Notice explains how we collect and use personal information and forms part of the information governing your use of Smart Animal.
Participation in research is separate from accepting these Terms. Where research participation is offered, you will be given separate information and asked to make a separate choice.
1. What Smart Animal is
Smart Animal is a digital health-recording and monitoring platform designed to help dog owners record, organise and review information relating to their dog’s health.
Depending on the features available to you, Smart Animal may allow you to:
- record symptoms and changes you observe in your dog;
- record medications and treatment information;
- complete regular health check-ins;
- record measurements and other health information;
- upload veterinary records, laboratory results, imaging reports and other documents;
- store photographs relating to your dog’s condition or progress;
- view information and trends based on data you have entered;
- organise information for discussion with your veterinary team;
- receive reminders, prompts, educational information or safety-related messages; and
- choose whether eligible information may be used for research.
Features may change as Smart Animal develops.
Smart Animal is currently focused on canine Cushing’s syndrome, although the Service may later be expanded to other conditions, animals or areas of animal health.
2. Smart Animal does not replace veterinary care
Smart Animal is designed to support record keeping, observation and communication between dog owners and veterinary professionals.
Smart Animal is not a veterinary practice and does not provide veterinary diagnosis, veterinary treatment or veterinary prescriptions.
Information provided through Smart Animal is not a substitute for examination, diagnosis, treatment or advice from a qualified veterinary professional who knows your dog’s individual medical circumstances.
You must not use Smart Animal to:
- diagnose a condition;
- decide whether your dog requires veterinary treatment;
- start or stop a medication;
- change the dose or frequency of a medication;
- delay veterinary assessment;
- decide that veterinary assessment is unnecessary; or
- make an emergency treatment decision.
Always follow the instructions provided by the veterinary professional responsible for your dog’s care.
If information displayed by Smart Animal differs from advice given by your veterinary professional, you should contact your veterinary professional rather than changing your dog’s treatment yourself.
3. Emergencies and urgent veterinary care
Smart Animal is not an emergency veterinary service.
The Service cannot assess your dog physically and cannot guarantee that it will identify an emergency or deterioration in your dog’s condition.
Do not wait for an alert, notification, recommendation or other response from Smart Animal before seeking veterinary help.
If your dog appears seriously unwell, deteriorates rapidly, collapses, has difficulty breathing, experiences seizures, is unresponsive, or you otherwise believe your dog may require urgent care, contact a veterinary professional or emergency veterinary service immediately.
Any alert or safety message provided by Smart Animal is intended only as an additional prompt to seek appropriate veterinary advice. The absence of an alert does not mean that your dog is well or that veterinary assessment is unnecessary.
4. Medication information
Smart Animal may allow you to record medication names, doses, schedules, treatment changes and related information.
This functionality is intended to help you maintain a record of treatment prescribed or recommended by your veterinary professional.
Smart Animal does not prescribe veterinary medicines.
Smart Animal does not determine what medication your dog should receive and does not calculate, prescribe or recommend an individual medication dose.
Smart Animal does not replace your dog’s prescribed medication schedule. You should continue to follow the schedule set by your veterinary professional.
You remain responsible for checking medication instructions against the prescription, dispensing label or instructions provided by your veterinary professional.
Never change your dog’s medication solely because of information displayed by Smart Animal.
5. Information and educational content
Smart Animal may provide educational information concerning Cushing’s syndrome, veterinary investigations, monitoring, medications, symptoms, complications or other animal-health subjects.
We aim to base this material on peer-reviewed veterinary and scientific literature and established veterinary guidance, and to review it as the evidence develops.
However, veterinary knowledge changes over time and individual dogs differ substantially.
Educational material is therefore provided for general information and should not be interpreted as individual veterinary advice.
Where appropriate, users should discuss information obtained through Smart Animal with their veterinary professional.
6. Information you enter into Smart Animal
The usefulness of Smart Animal depends substantially on the information entered into it.
You are responsible for taking reasonable care to ensure that information you enter is accurate.
This includes, where applicable:
- your dog’s details;
- symptoms and observations;
- medication names and doses;
- laboratory values;
- dates;
- measurements;
- veterinary diagnoses;
- uploaded records; and
- information transcribed from veterinary documents.
We recognise that owners may sometimes be uncertain about information or make mistakes. These Terms do not require you to guarantee that every observation is medically correct.
However, you must not knowingly enter false, fabricated or deliberately misleading information.
7. Automated extraction and processing of documents
Some Smart Animal features may automatically extract or organise information from uploaded veterinary records, laboratory reports or other documents.
Automated extraction technologies can make mistakes.
You should verify extracted information against the original veterinary document before relying upon or sharing it.
Smart Animal’s extracted or transcribed version does not replace the original veterinary record.
8. Accounts and eligibility
You must be at least 18 years old to create a Smart Animal account.
You must provide accurate account information and keep your login credentials secure.
You are responsible for activity carried out through your account where that activity results from your failure to take reasonable steps to protect your login credentials.
If you believe someone has gained unauthorised access to your account, please contact us at support@smart-animal.com.
You may not create an account using another person’s identity without their permission.
9. Children
Smart Animal accounts are only available to individuals aged 18 or over (Section 8). We do not knowingly collect personal information directly from children. If you believe a child has provided us with personal information, please contact us at support@smart-animal.com so that we can investigate and, where appropriate, delete it.
10. Veterinary records and third-party information
You may upload veterinary records and other information relating to your dog.
You should only upload material that you are entitled to possess and use. By uploading any document, image or other material, you confirm that, to the best of your knowledge, you are entitled to do so. If you deliberately upload material knowing that you do not have the right to upload or share it, Section 19 (Indemnity by you) may apply.
Veterinary documents may contain names, contact details or other information relating to veterinary professionals, veterinary practices or other individuals.
We process personal information contained within uploaded materials as described in our Privacy Notice.
You must not deliberately upload information about unrelated individuals where it is unnecessary for the purpose for which you are using Smart Animal.
11. Photographs
Smart Animal may allow you to upload photographs of your dog for personal health tracking and comparison over time.
You must have the right to upload any photograph you submit.
If a photograph contains an identifiable person, you should have an appropriate basis for uploading and using that photograph.
Uploading a photograph for use within your own Smart Animal account does not automatically give Smart Animal Technologies permission to publish that photograph, use it for marketing, or make it publicly available.
Where we wish to use photographs for another purpose, including research where separate permission is appropriate, publication, promotional material or marketing, we will obtain the relevant permission separately.
12. Research participation
One of Smart Animal’s long-term purposes is to help improve understanding of canine Cushing’s syndrome and other areas of animal health using data collected from ongoing real-world use of Smart Animal over time.
Using Smart Animal does not automatically enrol you in research.
Ordinary use of anonymous animal information, as described in Section 14 (Anonymous animal data) below, is not enrolment in the optional research contribution described in this section, and does not require the separate choice described in this section.
Where research participation is available, we will provide separate information explaining the relevant use of data and ask you to make a separate choice.
You may use the core Smart Animal service whether or not you choose to participate in research, unless a particular optional feature is expressly identified as part of a specific research study.
Research participation, withdrawal and the processing of information for research purposes are governed by the applicable research information, consent process and Privacy Notice.
Where information has been effectively anonymised so that you are no longer identifiable, it may no longer be possible to identify and remove that information from an existing anonymised dataset.
Where applicable, this will be explained before you choose to participate.
13. Research collaboration and commercial independence
Smart Animal Technologies may collaborate with universities, veterinary researchers, research institutions and other appropriately governed organisations, and may enter into academic, non-profit, public-sector or commercial partnerships, where these support the development of Smart Animal, animal-health research or related activities.
Any sharing or access to information will be governed by applicable law, appropriate safeguards, the relevant arrangements and our Privacy Notice, and must have an appropriate legal basis under applicable data-protection law.
Research collaboration or a commercial relationship does not give a third party unrestricted access to Smart Animal user information, ownership of individual users’ accounts, or an unrestricted right to access identifiable user information.
Where research outputs are published, Smart Animal Technologies will use aggregated or appropriately anonymised information unless an individual has separately and expressly agreed to identification for that specific purpose. We will not otherwise intentionally publish research results in a form that identifies an individual user. Where relevant to research integrity, material research funding, sponsorship or conflicts of interest should be disclosed in accordance with customary academic and scientific publication practice (for example, disclosure requirements imposed by the relevant journal, funder or research institution).
14. Anonymous animal data
Information relating solely to an animal will not generally, by itself, identify its owner as a natural person. However, animal information may constitute or form part of personal data where it identifies, relates to, or can reasonably be linked to an identifiable person.
Where permitted by applicable law, Smart Animal Technologies may create anonymous animal data from information collected through Smart Animal by removing or separating information that identifies or could reasonably identify an individual person.
Once information has been effectively anonymised so that it no longer constitutes personal data under applicable data-protection law, Smart Animal Technologies may retain, analyse, combine, aggregate and otherwise use that anonymous animal data for lawful purposes connected with animal health, welfare, veterinary science, research and the development of Smart Animal and related animal-health technologies, including:
- improving, developing, testing and evaluating Smart Animal and its features;
- understanding patterns in animal health, disease, treatment and monitoring;
- statistical analysis and benchmarking;
- developing analytical methods, tools and technologies;
- supporting animal-health and veterinary research;
- producing aggregated insights, reports and publications; and
- supporting academic, scientific and commercial collaborations consistent with Smart Animal Technologies’ animal-health purposes.
Anonymous animal data may be retained after an account is deleted or after the original information from which it was created is no longer retained, where permitted by law.
We will not treat information as anonymous merely because obvious identifiers have been removed. Where information remains capable of being linked to an identifiable person, we will treat it as personal data and process it in accordance with our Privacy Notice and applicable data-protection law.
Nothing in this section permits Smart Animal Technologies to disclose identifiable user information or personal data contrary to applicable law or our Privacy Notice.
15. Ownership of your information
You retain any rights you have in information, photographs and other content that you submit to Smart Animal.
You give Smart Animal Technologies the rights reasonably necessary to host, store, process, reproduce and technically use that content for the purpose of operating Smart Animal, providing the features you request, maintaining and securing the Service, and otherwise processing it as described in our Privacy Notice and any separate permissions you have given.
This is subject to our rights to create and use anonymous animal data as described in Section 14 (Anonymous animal data).
This does not transfer ownership of your original content to Smart Animal Technologies.
Nothing in these Terms gives us permission to sell identifiable veterinary records or personal information simply because you have uploaded them to Smart Animal.
16. Smart Animal intellectual property
Smart Animal, including its software, design, branding, databases, original written material, interfaces, graphics, functionality, algorithms and other proprietary material, is owned by or licensed to Smart Animal Technologies Ltd and is protected by applicable intellectual-property laws.
Except where permitted by law, you may not:
- copy or redistribute substantial parts of the Service;
- attempt to obtain Smart Animal’s source code through unauthorised means;
- circumvent security measures;
- scrape or systematically extract Smart Animal data or content without permission;
- use Smart Animal’s branding in a way that suggests endorsement or affiliation without permission; or
- commercially exploit Smart Animal’s proprietary material without our written permission.
Nothing in these Terms prevents ordinary use of information about your own dog, including downloading, showing or providing that information to your veterinary professionals.
17. App Store / platform distribution terms
Where you access Smart Animal through the Apple App Store, the following applies in addition to, and where necessary in priority over, the sections above.
Acknowledgement: this licence is an agreement between you and Smart Animal Technologies only, not Apple. Smart Animal Technologies, not Apple, is solely responsible for Smart Animal and its content, and nothing in these Terms conflicts with the Usage Rules in Apple’s Media Services Terms and Conditions.
Scope of licence: the licence granted to you is a non-transferable licence to use Smart Animal on Apple-branded devices that you own or control, as permitted by those Usage Rules, except that Smart Animal may also be accessed by other accounts associated with you via Family Sharing.
Maintenance and support: we, not Apple, are solely responsible for providing any maintenance and support for Smart Animal; Apple has no obligation to furnish any maintenance or support.
Warranty: we, not Apple, are solely responsible for any product warranties. If Smart Animal fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for Smart Animal (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation regarding Smart Animal, and any other claims, losses, liabilities, damages, costs or expenses attributable to that failure are our sole responsibility.
Product claims: we, not Apple, are responsible for addressing any claim by you or a third party relating to Smart Animal or your possession or use of it, including product liability claims, claims that Smart Animal fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. Nothing in these Terms limits our liability to you beyond what applicable law permits.
Intellectual property: we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of any claim that Smart Animal or your possession and use of it infringes a third party’s intellectual property rights.
Legal compliance: you represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
Our name, address and contact details are set out in Section 35 (Contact).
You must comply with applicable third-party terms of agreement when using Smart Animal (for example, your mobile network or data agreement).
Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
18. Acceptable use
You must not use Smart Animal:
- unlawfully or fraudulently;
- to intentionally provide fabricated data;
- to interfere with the operation or security of the Service;
- to introduce malware or malicious code;
- to gain unauthorised access to another user’s account or information;
- to conduct automated scraping or bulk extraction without permission;
- to impersonate another person;
- to infringe another person’s intellectual-property or privacy rights;
- to attempt to re-identify any individual from anonymised or aggregated information made available through Smart Animal; or
- in a way that could reasonably cause material harm to Smart Animal, its users or its systems.
19. Indemnity by you
To the extent permitted by law, you agree to indemnify (that is, compensate) Smart Animal Technologies against losses, costs and claims (including reasonable legal costs) that arise directly from: (a) your deliberately uploading material that you know you are not entitled to upload or share; (b) your deliberate or seriously reckless breach of Section 18 (Acceptable use); or (c) your intentional violation of another person's rights through your use of Smart Animal. This indemnity does not cover innocent mistakes — for example, uploading a document your veterinary practice sent you that turns out to raise an unforeseen third-party rights issue — and does not apply to the extent the loss, cost or claim arises from our own breach of these Terms or failure to exercise reasonable care.
20. Availability of the Service
We aim to keep Smart Animal available and reliable, but no online service can be guaranteed to operate continuously.
Smart Animal may occasionally be unavailable because of maintenance, updates, security incidents, technical failures, internet outages or circumstances outside our reasonable control.
We may modify, add, remove or replace features as the Service develops.
Where a change materially affects users’ rights or the core nature of the Service, we will provide appropriate notice where reasonably practicable and legally required.
We may restrict the availability of Smart Animal, or particular features, by country or territory where reasonably necessary to comply with legal or regulatory requirements, or where reasonably necessary for other legitimate operational reasons (for example, security or technical limitations).
21. Beta and developing features
Smart Animal may initially be released as a beta or developing service.
During this period, features may change and users may encounter bugs, interruptions or incomplete functionality.
This does not remove our obligation to take reasonable care in operating the Service or any rights you have under applicable law.
Please report suspected technical problems to support@smart-animal.com.
If a problem concerns potentially incorrect health information, medication information or a safety-related feature, please tell us as soon as reasonably possible so that we can investigate it.
22. Third-party services and links
Smart Animal may contain links to external websites, veterinary services, scientific publications or other third-party resources.
A link does not necessarily mean that Smart Animal Technologies endorses that organisation, service, product or all information appearing on the external site.
Third-party services operate under their own terms and privacy policies, and we are not responsible for services outside our control.
23. Security and backups
We use technical and organisational measures designed to protect information handled through Smart Animal, such as encryption, access controls and staff confidentiality obligations.
However, no electronic system can guarantee absolute security.
You should keep your account credentials secure and maintain copies of important veterinary documents where appropriate.
Smart Animal should not be treated as the only permanent repository for information that may be essential to your dog’s veterinary care.
24. Limitation of liability
We do not guarantee that Smart Animal will be available at all times or operate without interruption, that information entered by users or extracted from uploaded documents will always be accurate, or that Smart Animal will identify every deterioration, symptom or issue affecting your dog — the limitations explained in Sections 2 to 4 and Section 20 (Availability of the Service) apply. Nothing in these Terms excludes or limits our responsibility to provide Smart Animal with reasonable care and skill, or any other right you have under applicable consumer law that cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded under applicable consumer law.
To the extent permitted by law, Smart Animal Technologies is not responsible for loss or damage caused solely by:
- inaccurate information entered by a user;
- a user’s failure to follow veterinary instructions;
- a user’s decision to change or discontinue treatment without appropriate veterinary advice;
- reliance on Smart Animal as a substitute for professional veterinary assessment;
- failure to seek veterinary care because an alert was not generated;
- third-party systems or services outside our reasonable control; or
- circumstances that we could not reasonably have prevented despite taking appropriate care.
Nothing in this section removes our responsibility for loss or damage caused by our own failure to exercise the level of care required by applicable law.
Smart Animal is provided primarily for personal and non-commercial use. We are therefore not responsible for business losses suffered through use of the consumer Service where such losses were not reasonably contemplated as part of your use of Smart Animal.
25. Your statutory rights
These Terms do not affect any rights you have under applicable consumer, data-protection or other laws.
If any provision of these Terms conflicts with a right that cannot lawfully be excluded or restricted, that statutory right takes priority.
26. Suspension and termination
You may stop using Smart Animal at any time.
You may request deletion of your account in the app (Settings, then Delete account) or at https://smart-animal.com/delete-account.
We may suspend or terminate access where reasonably necessary, including where:
- you seriously or repeatedly breach these Terms;
- we reasonably believe an account is being used fraudulently;
- continued access creates a material security risk;
- we are required to do so by law; or
- continued operation of the Service becomes impossible or unlawful.
Where reasonably possible and appropriate, we will give you notice and an opportunity to address a breach before terminating your account.
Account deletion and termination do not necessarily mean that every piece of information is immediately erased. Information may need to be retained where required by law, for security or legal claims, or where another lawful basis for retention applies.
Information that has previously been effectively anonymised may no longer constitute personal data and may not be capable of being linked back to your account for deletion.

27. Ending Smart Animal
We intend to operate Smart Animal over the long term, but we cannot guarantee that the Service will exist indefinitely.
If we decide to discontinue the Service, we will take reasonable steps to provide advance notice where practicable and, where reasonably possible, provide users with an opportunity to retrieve relevant information associated with their account.
28. Changes to these Terms
We may update these Terms when Smart Animal changes or where changes are required for legal, regulatory, security or operational reasons.
For minor changes that do not materially affect your rights, we may update the Terms and change the “Last updated” date.
If a change materially affects your rights or obligations, we will provide reasonable notice and, where required by law, ask you to accept the updated Terms before continuing to use the Service.
We will not retrospectively convert a separate optional research or marketing choice into mandatory consent merely by changing these Terms.
We will not make changes retrospectively in a way that unfairly removes rights you already have.
29. Business transfers
If Smart Animal Technologies undergoes a merger, acquisition, reorganisation or transfer of some or all of its business or assets, information associated with the Service may be transferred as part of that transaction, subject to applicable data-protection law and our Privacy Notice.
Anonymous animal data may form part of the assets transferred with Smart Animal.
30. Privacy and data protection
Our processing of personal information is described in the Smart Animal Privacy Notice.
The Privacy Notice explains, among other things:
- what personal information we collect;
- why we collect it;
- our lawful bases for processing;
- how long information is retained;
- who information may be shared with;
- international transfers where applicable;
- research-related processing;
- anonymisation and pseudonymisation;
- your data-protection rights; and
- how to contact us about privacy.
Please read the Privacy Notice before using Smart Animal.
31. Communications
We may send communications that are necessary to operate your account or provide the Service, including security messages, important service changes and information necessary to administer features you use.
Promotional or marketing communications are treated separately.
Where consent or another legal requirement applies to electronic marketing, accepting these Terms does not constitute consent to receive marketing communications.
You may be offered a separate choice about receiving news, project updates, research updates or other optional communications.
32. Complaints and contacting us

We will take reasonable steps to investigate and respond.
33. Governing law and courts
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom or another country, you may also benefit from mandatory protections provided by the laws of the country in which you live.
Nothing in these Terms deprives you of mandatory consumer protections that apply to you.
The courts of England and Wales have non-exclusive jurisdiction over any dispute arising from these Terms. This does not affect your right, if you are a consumer, to bring proceedings in the courts of the country in which you live.
34. General provisions
If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.
A delay by Smart Animal Technologies in enforcing a provision does not automatically mean that we have waived our right to enforce it later.
These Terms govern the relationship between you and Smart Animal Technologies concerning your use of Smart Animal. They do not give enforcement rights to another person except where the law expressly provides otherwise.
